If you are interested in applying for a permit to host or conduct a Community Parade or Community Event, within the Municipal Boundary of East Palestine, Ohio, please complete the following application and attach any additional information or documents associated with the event. Completed forms are forwarded to the appropriate Village of East Palestine Staff who will review the data in coordination with relevant Village Departments including but not limited to Police, Fire, Streets, Park, etc. Applicants will be contacted by a representative who will issue a license to operate, deny the application or request further details. Note that applicants must review and sign the Waiver or Release of Liability, which will be required prior to event permissions being finalized.

Community Parade or Event Permit Request

WAIVER/RELEASE OF LIABILITY AND INDEMNITY AGREEMENT 

This Release of Liability and Indemnity Agreement ("Agreement") is entered into on Upon Submission of this form by and between The Village of East Palestine, a municipal corporation organized under the laws of Ohio ("Municipality"), and myself and the organization as defined in this Submission, which I represent.    
  1. WHEREAS, the Event Holder desires to conduct an Event ("Event") on The dates defined in this submission, at the location identified in this submission, a property owned or controlled by the Municipality; and
  2. WHEREAS, the Municipality agrees to permit the Event Holder to use the designated premises for the Event, subject to the terms and conditions of this Agreement; and
  3. WHEREAS, the Event Holder acknowledges that hosting the Event may involve inherent risks, and the Municipality requires protection from liability for any claims arising from the Event. 
  4. NOW, THEREFORE, in consideration of the Municipality’s permission to use the premises for the Event, the Event Holder agrees as follows. 
Assumption of Risk The Event Holder acknowledges that participation in or attendance at the Event involves inherent risks, including but not limited to bodily injury, illness, death, property damage, or other losses, whether caused by the negligence of the Event Holder, attendees, third parties, or otherwise. The Event Holder, on behalf of itself, its employees, agents, contractors, volunteers, participants, and attendees (collectively, "Event Parties"), voluntarily assumes all risks associated with the Event. 

Release and Waiver of Liability The Event Holder, for itself and on behalf of the Event Parties, hereby fully and forever releases, waives, discharges, and covenants not to sue the Municipality, its elected officials, officers, employees, agents, volunteers, or representatives (collectively, "Municipal Parties") from any and all claims, demands, actions, causes of action, liabilities, damages, costs, or expenses (including attorney’s fees) arising out of or related to any injury, illness, death, property damage, or other loss sustained by any person or entity in connection with the Event, whether caused by the negligence of the Municipal Parties or otherwise, to the fullest extent permitted by law. 

Indemnification  The Event Holder agrees to indemnify, defend, and hold harmless the Municipal Parties from and against any and all claims, demands, actions, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of or related to: a. The Event Holder’s use of the premises; b. Any act, omission, or negligence of the Event Holder or any Event Parties; c. Any injury, illness, death, property damage, or other loss sustained by any person or entity in connection with the Event; or d. Any breach of this Agreement by the Event Holder.  

This indemnification obligation shall survive the termination of this Agreement and the conclusion of the Event. 

Compliance with Laws and Permits  The Event Holder shall comply with all applicable federal, state, and local laws, regulations, and ordinances, including but not limited to those governing public safety, health, and accessibility. The Event Holder shall obtain all necessary permits, licenses, or approvals required for the Event and provide copies to the Municipality upon request. 

No Warranty The Municipality makes no warranty, express or implied, regarding the condition or suitability of the premises for the Event. The Event Holder accepts the premises "as is" and is responsible for inspecting the premises prior to the Event to ensure they meet the Event Holder’s needs. 

Termination  The Municipality reserves the right to terminate the Event Holder’s use of the premises at any time, with or without cause, if the Municipality determines, in its sole discretion, that the Event poses a risk to public safety or violates the terms of this Agreement. In such cases, the Municipality shall not be liable for any costs, damages, or losses incurred by the Event Holder. 

Governing Law and Venue  This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any legal action arising out of this Agreement shall be brought exclusively in the courts of Columbiana, Ohio, and the Event Holder consents to the jurisdiction of such courts. 

Severability  If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

Entire Agreement  This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral, relating to the Event. This Agreement may not be modified except in writing signed by both parties.
